UPDATE: Richmond Man, Un-Hit By Concord PD Gunfire, Charged With Attempted Murder – Assault On Officers

CONCORD, CA – This past Thursday, April 3rd, shortly after 10 pm, a Concord Police Department patrol officer attempted to make a traffic stop on a Chrysler sedan on Ellis Street near Clayton Road. The driver of the Chrysler, later identified as Eric Darrall Foreman, a 37-year-old male from Richmond, exited his vehicle and fled of foot prior to his vehicle coming to a complete stop, which caused it to collide with another vehicle.

A Concord Police Department officer gave chase to Foreman on foot through an apartment complex and across Clayton Road into the parking lot of PetSmart, located at 1700 Willow Pass Road. Foreman suddenly stopped running, stood in the middle of the parking lot, and despite multiple commands to stop from the officer, pulled a handgun out of his pants, and turned towards the officer holding it in his hand. An officer involved shooting then occurred. Foreman was not struck by the gunfire from the officer and continued to flee, running southeast through the parking lot and then east along the sidewalk of Clayton Road.

When a second responding officer attempted to stop Foreman, Foreman pointed his handgun at that officer and a second officer involved shooting occurred in front of 1741 Clayton Road. Foreman again was not struck by gunfire and ultimately hid in the area of Sutter Street and Clayton Road.

A perimeter was quickly established around the area Foreman was hiding. Additional resources were requested and arrived, including a Contra Costa County Sheriff’s Office helicopter, K9 officer, and drone team, as well as Pittsburg PD and Pleasant Hill PD officers. Foreman attempted to escape the perimeter but was ultimately apprehended by a Contra Costa County Sheriff’s Office K9. Foreman was found to be in possession of a loaded handgun at the time of his arrest.

Concord Police Department detectives and the Contra Costa County Sheriff’s Office Crime Lab responded and conducted the investigation. Subsequent investigation showed that Foreman had attempted to shoot at the officers. Foreman was ultimately booked into the Martinez Detention Facility.

Today, the Concord Police Department Major Crimes Unit presented the case to the Contra Costa District Attorney’s Office who charged Foreman with multiple counts of attempted murder, assault with a deadly weapon on a police officer, possession of a handgun and ammunition by a convicted felon, hit-and-run, and obstructing an investigation.

    • I, for one, can’t take you seriously. You are operating on a political agenda. This was clearly a serious, chargeable crime so long as the police operated professionally in the arrest, and you would make a mockery of it and the office of the DA.

  1. So nowhere in this article say he shot at the officers so how the HELL does he have multiple attempted murder charges?? Am I missing something or did I read it wrong? Bcuz how do u get an attempted murder charge just by pointing a gun at someone? Hmm strange..Most likely bcuz of his skin color in racist ass Concord that has legit white supremacist there..Why don’t they come to Oakland with that weak ass shit?????

    • Dee, you are probably missing something. Pointing the gun at an officer, with intent to shoot him, is a direct step towards killing him, which is all it takes to constitute attempt. Now he can argue in court that he didn’t actually intend to shoot. And a jury might believe him and acquit on that charge. But if there’s evidence that he only didn’t actually pull the trigger because the police fired back too quickly and he ran away before he could get his sights on target, there’s a good chance of a conviction. If there’s evidence that when the gun was recovered it was uncocked, and there was an unfired round in the chamber with a dimple on the primer — indicating he actually did pull the trigger but fortunately for the officers he had a dud round loaded — that’s really not going to be good for him.

      And the officers don’t have to give him one free shot before they fire back.
