Golden Gate Division Investigative Services Unit arrested a man suspected of assault with a deadly weapon after a bizarre confrontation early Wednesday on Highway 24 west of the Caldecott Tunnel.

Investigators said the incident took place at approximately 2:15 a.m. in the westbound lanes, starting shortly after a Toyota Camry, driven by Tomes Torres, sustained a flat tire and became disabled. At some point thereafter, a Toyota Yaris pulled in behind the Camry also stopping in the freeway.

Seeing the two vehicles stopped along the highway, a Caltrans official pulled in behind the vehicles and approached the driver of the Camry in an effort to offer routine assistance to the disabled motorist. For still to be determined reasons a physical altercation ensued between the Caltrans official and Torres. During this melee Torres produced a hand gun, initially pointing it at the Caltrans official, and then up in the air where he fired the weapon twice causing the Caltrans employee to flee the area in his work truck. Torres then entered the Toyota Yaris and fled the scene to an unknown location.

A short time after, CHP arrived on scene and secured the area. All westbound lanes of Highway 24 were closed for approximately 45 minutes while officers canvassed the area for any evidence. Two .40 caliber spent shell casings were located behind the abandoned Toyota Camry.

CHP – Golden Gate Division Investigative Services Unit was requested to take the lead role in the investigation and at approximately 11:05 AM, the investigators were able to apprehend Tomes Torres, a 21-year-old Concord resident, placing him into custody for assault with a deadly weapon and booking him into the Santa Rita Jail.
