County Cracks Down On Businesses Not Heeding Health Order

At the direction of the Contra Costa County Board of Supervisors, Contra Costa Health Services began cracking down on businesses who do not comply with the County Health Order.

On Thursday, County Health Services provided a list, upon request, of what businesses in Contra Costa County have received a Notice of Violation, Notice of Fine, and Notice of Immediate Health Permit Suspension.

On Wednesday, the County issued 4 notices of violation, 1 fine, and 1 health permit suspension.

According to Karl Fischer, County Health Spokesperson:

“We consider the notice of violation to be the formal warning. The first time we receive a complaint about a permit holder, we will contact the business to provide information about the health orders and work with them to ensure they can meet health order requirements. We consider those cases resolved, unless we get subsequent complaints from the public about health order violations. Most of our cases are resolved through business education, including the majority of our complaint calls in November.

A notice of violation is issued when a business that we’ve already contacted receives a subsequent complaint. A health inspector visits the business, and if they observe health order violations, they issue the notice. That triggers automatic re-inspections and could lead to fines or other penalties, if inspectors observe violations on subsequent visits,” — Karl Fischer

A day after the Contra Costa County Board of Supervisors told health officials to shut down restaurants and continue to fine them should they refuse to comply with the County Health order, Lumpy’s Diner in the City of Antioch was temporarily shut down due to health order violation.

The diner was shut down Wednesday and Thursday morning was still closed pending approval to reopen. The owners of Lumpy’s said they have sent an email to the county of corrective actions and hope to reopen at some point in the next 24-hours.

Under the health order, restaurants who do not check customers proof of vaccine against COVID-19 or enforce masks, could face fines of $250, $500 or $1000 or ultimately could have their permit pulled.

On Tuesday, Anna Roth, Health Services Director, told the supervisors during the month of November, they had 99 complaints with 13 still in the enforcement process—80 different businesses.

In response to no fines, Supervisor Karen Mitchoff blasted County staff for not enforcing the health order.

“It seems to me that the time for education is over, the time for providing information is over, under the ordinance, the ordinance has progressed to the area where we need to be citing or issuing documents to shut them down,” stated Mitchoff. “The press is watching this very careful as is the public and I would like assurance that this week those types of actions will be taken. We have done the informing, we have done the educating, and its not fair to those businesses who are complying. Its not fair to the employees of those restaurants, patrons choose to go there, but employees work there.”

Roth said the complaints are now going directly to her office, however, Mitchoff was not impressed.

“I appreciate that but we are beyond that,” stated Mitchoff. There are businesses out there that you are aware of who have gone through all that administrative escalation. Are there 13-outliers out there who have gone through the fines, they have gone through the education they have not received that notice that its time to shut down. That is what I think this board needs to have assurance on.”

In October, multiple In-N-Out Burger restaurants were shut down by the County for not following the Health Order, however, they since reopened with drive-thru only.

 

COVID Overview in Contra Costa County

According to Anna Roth, Health Services Director, she shared the county had 1,284 cases of COVID-19—at one point, they were at 9% positivity rate on Nov. 23 and are now at 2.8% and explained the average case rate per 100% is very different based on vaccination status. That rate is 14.6 per 100,000 for unvaccinated while its 4.7 per 100,000 per vaccinated. 27 people are hospitalized with COVID-19.

“Unfortunately, we are still seeing one COVID death per day on average with 31 deaths since Nov. 7 in our county,” said Roth.

Roth highlighted 75.6 of Contra Costa County residents are fully vaccinated.  The county had a goal to get to 1 million doses by July 4, they met the goal by Memorial Day and as of last Friday, they hit 2 million doses of vaccines given in the county.

“This is a tremendous accomplishment and I want to acknowledge all the staff, employees across the county as well as the partners across the county. This is a very big accomplishment,” said Roth.

For children 5-11, they now have 30.9% of those who are now vaccinated with events through December.

As of Tuesday, there is no Omicron variant within Contra Costa County explained Roth who said its in the Bay Area—Delta variant remains prominent variant.

  1. Frankly I wish the county would crack down on serious crime, and all the criminals running around. They’re more of a danger to us than these violations.
    I think the politicians are loving this power they have over people. The courts though are ruling against some of this heavy-handedness. Don’t get me wrong I’m fully vaccinated and boosted and everybody should be…. But this growing Nazism scares me another ways.

  2. People who report these things are Karen’s who need to get a life. Now the unvaccinated know where to go, and the bottom line is increased for those restaurants. The restaurants that don’t check just want to make money and not alienate their customers. So tired of this BS.

    When did it come to pass that the Government punishes the people?

    I believe the Government should be allowing all medications available to help alleviate this Pandemic.

    I also believe every business should decide what restrictions to take, if any, for their business.

    Americans are good and decent people who know what’s best for themselves.

    Americans don’t need their Government telling them what they can or can’t do based on a medication.

    The Government can only paint with a broad brush. America is a country of individuals.

    I think the County’s orders concerning who can dine and who cannot is beyond the discretion of any Government entity.

      You realize we have a legal system to resolve questions like that. The county public health mandate is public safety. If you disagree with these measures, put your issue before the courts. It’s been found to be legal before, so I wouldn’t hold your breath. If you believe in observing the law, I would suggest doing your level best to comply with public health and safety measures. They save lives.

    • I totally agree. It’s a virus, not the black plague. Contra Costa County is a highly vaccinated county. Just be thankful most of us (including restaurants) don’t have this tyrannical, rigid, the sky is falling mindset. If you have underlying health issues and you’re scared, stay home. Hide under your bed while the rest of us return to normalcy. And if you’re in poor health due to an unhealthy lifestyle, you have nobody to blame but yourself. Quit drinking, smoking, doing drugs, overeating and refusing to exercise. Besides vaccines, losing weight makes sense. You’ll be happier and healthier, and it might keep you off a ventilator. Where is that message that needs to be sent?

  5. One of my favorite restaurants made the list, I will be eating there today. Their problem is that they don’t have enough staff to check vax cards, the owner can’t fine anyone to hire and she pays well, plus tips. 108RS

    That is a totally lame, fabricated excuse. The person who greets you and seats you can check your vax status and ID as any bartender can, as any reputable establishment does. Sorry, Alcoholic Beverage Control, we didn’t have the staff, didn’t have the time, blah blah, blah, to check IDs. That’s worse than sorry, that’s a pathetic line from former law enforcement.

    Sorry, Your Honor, we didn’t have the staff to check for weapons at entry to the courthouse, so they just went in.

    Keith, your Ted Nugent notion that this is no more than a cleansing of the herd is noteworthy for its cold calculus, but inaccurate. It’s more likely to cull young healthy store clerks, restaurant staff, transportation workers and others on the front line who work hard for a living. If it doesn’t kill them, it may render them unable to work and pay basic expenses. And, while it is soooo satisfying to think of THOSE WHO SUFFER as sinners or slackers deserving what they get, it is morally repugnant for those of us who have moved on from the Dark Ages and have more than one radio station on our dial.

  8. The “education required” is the county needs to follow the news. Employees should not be putting themselves in a dangerous position of asking for vaccine proof. Employees are getting shot and killed over mask disputes (usually low wage employees) and vaccine proof is more personal than a mask. If you don’t get it you’re naive at best and ignorant at worst. Government overreach needs to end. People are fighting back, and rightfully so.

  9. I stopped eating out at restaurants more than 10 years ago. I get it to go and eat at my house. People are annoying. I don’t want to eat around people.
