Judge Issues Preliminary Injunction Order Preventing PG&E From Removing 17 Trees In Lafayette

LAFAYETTE, CALIF., Nov. 20, 2020-At a hearing today, Judge Dennis Montali of the United States Bankruptcy Court for the Northern District of California issued a Preliminary Injunction Order preventing PG&E from removing 17 trees located in City of Lafayette on East Bay Regional Park District property.

The Preliminary Injunction Order will remain in effect pending further order of the Court.

Previously, the judge had issued a limited Temporary Restraining Order in City of Lafayette v. PG&E (Adv. No. 20-03124), a case in which the City contends that PG&E failed to comply with a 2017 Tree Removal Agreement in seeking to cut down the trees.

The judge expects PG&E to submit the required site plan and mitigation plan to the City of Lafayette with the City Council conducting expedited review of the plan. While there is no expiration on the Preliminary Injunction, the Judge told PG&E that the utility could seek a hearing on an expedited basis if there were delays in the proceedings.
